Roman Catholic teaching on torture has undergone evolution. At one time the Church endorsed the use of torture in trials and investigations. Today theproscription of torture is absolute, according to the Compendium of the Social Doctrine of the Church. What accounts for this development? This essaymaintains that Catholicism’s increased appreciation for the centrality of freedom to the experience of human dignity provides the rationale for the church’steaching on torture. While utilitarian and other forms of argument may be used by opponents (...) to torture, the Catholic argument is fundamentally deontological.Contemporary forms of torture have as their aim the breakdown of a victim’s inner freedom. For that reason torture, as it is practiced today, is judged to beespecially antithetical to the Catholic understanding of the image of God within the person, the exercise of freedom as self-determination. The essay begins with an explanation of the underlying theological vision that supports Catholic social teaching's commitment to the centrality of the common good and the role of solidarity as both a virtue and a norm. The vision of humanity as one family and the church as a sacrament of unity is the foundation for a communitarian ethic that prizes inclusion, participation, and relative equality in the quest for a truly just society. An array of social science studies is then (...) employed to show that economic inequality “bleeds” into other realms of public life to undermine fundamental commitments of American society, namely, equal opportunity and political democracy. In recent years we have seen a renewal in the field of Christian ethics that is both ecumenical and interdisciplinary. This book gathers together key contributions by leading moral theologians, as well as psychologists and Scripture scholars, to provide a basic introduction to the discipline.

Few if any of Kant’s critics were more trenchant than Hegel. Here I reconstruct some objections Hegel makes to Kant in a text that has received insufficient attention, the chapter titled ‘the Moral World View’ in the Phenomenology of Spirit. I show that Kant holds virtually all the tenets Hegel ascribes to ‘the moral world view’. I concentrate on five of Hegel’s main objections to Kant’s practical metaphysics. First, Kant’s problem of coordinating happiness with virtue (as worthiness to be happy) (...) is contrived. Kant denies that there is any inherent connection between acting rightly and being happy, but his denial depends on his defining happiness in terms of satisfying inclinations, rather than in terms of achieving ends in general. Second, Kant’s view of moral motivation is contrived; he ultimately admits that we cannot resolve to act without taking inclinations into account. (We cannot resolve to act apart from the matter of our maxim.) Third, Kant’s idea about perfecting our virtue in an infinite progress is incoherent. Kant defines virtue, and evidence of virtue, in terms of overcoming inclinations. Inclinations die with the body. Therefore there can be neither virtue nor evidence of virtue after death. Fourth, Kant’s view of the autonomy of moral agency is inconsistent with viewing the moral law as a divine command. Fifth, Kant’s moral principles cannot be put into practice in concrete circumstances because he supplies inadequate guidance for classifying acts. I conclude that Hegel’s objections to Kant’s practical metaphysics are sound, and I show that the problems Hegel raised against Kant’s account of autonomy and moral motivation are still current, since they have not been resolved, e.g., by Onora O’Neill’s Constructions of Reason. Onora O’Neill has contributed enormously to moral philosophy (broadly speaking, including both ethics and political philosophy) by identifying Kant’s unique and powerful form of normative constructivism. Frederick Neuhouser has contributed similarly by showing that all of Hegel’s standards of moral rationality aim to insure the complete development of three distinct, complementary forms of personal, moral and social freedom. However, Neuhouser’s study does not examine Hegel’s justificatory methods and principles. The present article aims to reinforce and extend Neuhouser’s findings by explicating (...) Hegel’s basic principles for justifying practical norms. Surprisingly, Hegel’s basic principles of normative justification are rooted in Kant’s constructivism, as explicated by O’Neill. Hegel’s adaptation and development of Kant’s constructivism results in a powerful form of constructivism about moral principles which merits contemporary interest because it is more powerful and more objectivist than familiar contemporary forms of constructivism. The First World War was supposed to end all wars, though soon followed WWII. Since 1945 wars continued to abound; now we confront a real prospect of a third world war. Many armed struggles and wars arise in attempts to end repressive government; still more are fomented by repressive governments, few of which acknowledge their repressive character. It is historically and culturally naive to suppose that peace is normal, and war an aberration; war, preparations for war and threats of war (...) belong to ‘normal’ human life. Our tolerance, acceptance or fostering of such repeated injustices and atrocities indicate pervasive failures to understand fundamentals of justice, and what we owe morally to ourselves and to all others, together with our responsibilities to preserve the biosphere, not merely our own store(s) of reserves. As matters both of justice and prudence we must re-orient ourselves, individually and collectively, to promote justice, peace and ecological responsibilities by identifying and instituting just forms of social cooperation, domestically and internationally. All of these are our problems, whether we recognize them or continue our pervasive negligence. We urgently require cogent understanding of the social dimensions of human judgment, rational assessment, right action, and public reason. This requires understanding (inter alia) how Kant’s explication of rational judgment and justification is fundamentally social, how these features of rational judgment and justification are constitutive of Kant’s account of individual autonomy, and how they are central to Kant’s account of proper public use of reason. Reasoning publically remains precarious, not because – as often alleged – the ‘Enlightenment project’ has failed. It has not failed, it has been thwarted, and in our public responsibilities we have too often failed it. (shrink)

Kenneth R. Westphal presents an original interpretation of Hume's and Kant's moral philosophies, the differences between which are prominent in current philosophical accounts. Westphal argues that focussing on these differences, however, occludes a decisive, shared achievement: a distinctive constructivist account of the basic principles of justice which justifies their strict objectivity without invoking moral realism nor moral anti- or irrealism. Westphal explores how Hume developed a kind of constructivism for basic property rights and for government, and how Kant greatly (...) refined Hume's construction of justice within his 'metaphysical principles of justice', whilst preserving the core model of Hume's innovative account. Westphal contends that Hume's and Kant's constructivism avoids the conventionalist and relativist tendencies latent if not explicit in contemporary forms of moral constructivism. (shrink)

This Open Access book provides both a broad perspective and a focused examination of cow care as a subject of widespread ethical concern in India, and increasingly in other parts of the world. In the face of what has persisted as a highly charged political issue over cow protection in India, intellectual space must be made to bring the wealth of Indian traditional ethical discourse to bear on the realities of current human-animal relationships, particularly those of humans with cows. Dharma, (...) yoga, and bhakti paradigms serve as starting points for bringing Hindu--particularly Vaishnava Hindu--animal ethics into conversation with contemporary Western animal ethics. The author argues that a culture of bhakti--the inclusive, empathetic practice of spirituality centered in Krishna as the beloved cowherd of Vraja--can complement recently developed ethics-of-care thinking to create a solid basis for sustaining all kinds of cow care communities. Kenneth Westphal first examines Kant's methods and strategies for examining human sensory-perceptual experience, and then examines Kant's central, proper, and subtle attention to judgment, and so to the humanly possible valid use of concepts and principles to judge particulars we confront. In this book, Westphal offers an original interpretation of Hegel's moral philosophy. Building on his previous study of the role of natural law in Hume's and Kant's accounts of justice, Westphal argues that Hegel developed and justified a robust form of civic republicanism. Westphal identifies, for the first time, the proper genre to which Hegel's Philosophical Outlines of Justice belongs and to which it so prodigiously contributes, which he calls Natural Law Constructivism, an approach developed by Hume, Rousseau, Kant, and (...) Hegel. He brings to bear Hegel's adoption and augmentation of Kant's Critique of rational judgment and justification in all non-formal domains to his moral philosophy in his Outlines. Westphal argues that Hegel's justification for the standards of political legitimacy successfully integrates Rousseau's Independence Requirement into the role of public reason within a constitutional republic. In these regards, Hegel's moral and political principles are progressive not only in principle, but also in practice. Hegel's Civic Republicanism will be of interest to scholars of moral philosophy, social and political philosophy, philosophy of law, Hegel, eighteenth- and nineteenth-century philosophy. (shrink)

I argue that Harry Frankfurt’s doctrine of sufficiency, properly understood, presents a plausible alternative to egalitarianism. My position may be more general than Frankfurt’s, insofar as he limits himself to economic sufficiency; on my view, insufficiency is a generic reason for the rejection of principles governing permissible behavior. By situating sufficiency within a contractualist framework of moral permissibility, I provide an alternative to common (and, I think, mistaken) characterizations of the doctrine of sufficiency as either subordinate to equality or primarily (...) concerned with maximizing cases of sufficiency. What were the impacts of the Covid‐19 pandemic on trust in public health information, and what can be done to rebuild trust in public health authorities? This essay synthesizes insights from science and technology studies, information studies, and bioethics to explore sociotechnical factors that may have contributed to the breakdown of trust in public health information during the Covid‐19 pandemic. The field of science and technology studies lays out the dynamic nature of facts, helping to explain rapid shifts in public (...) health messaging during Covid‐19 and reasons they produced a lack of trust in public health authorities. The information field looks at how facts are sociotechnically constructed through systems of classification, illustrating how extrascientific factors influence public health authorities. Putting these perspectives alongside bioethics principles raises additional factors to consider. The goal of this essay is to learn from past failures to point toward a brighter future where trust in public health authorities can be rebuilt, not on faith, but rather through striving for calibrated trust within which, through a virtuous circle, trust is validated. Focusing on the ground-breaking and often controversial science of Charles Darwin, the author seeks to bridge the gulf between science and religion on the subject of human evolution.

Ilinca Zarifopol-Johnston's critical biography of the Romanian-born French philosopher E. M. Cioran focuses on his crucial formative years as a mystical revolutionary attracted to right-wing nationalist politics in interwar Romania, his writings of this period, and his self-imposed exile to France in 1937. This move led to his transformation into one of the most famous French moralists of the 20th century. As an enthusiast of the anti-rationalist philosophies widely popular in Europe during the first decades of the 20th century, Cioran (...) became an advocate of the fascistic Iron Guard. In her quest to understand how Cioran and other brilliant young intellectuals could have been attracted to such passionate national revival movements, Zarifopol-Johnston, herself a Romanian emigré, sought out the aging philosopher in Paris in the early 1990s and retraced his steps from his home village of Rasinari and youthful years in Sibiu, through his student years in Bucharest and Berlin, to his early residence in France. Her portrait of Cioran is complemented by an engaging autobiographical account of her rediscovery of her own Romanian past. (shrink)

A radical, optimistic exploration of how humans evolved to develop reason, consciousness, and free will. Lately, the most passionate advocates of the theory of evolution seem to present it as bad news. Scientists such as Richard Dawkins, Lawrence Krauss, and Sam Harris tell us that our most intimate actions, thoughts, and values are mere byproducts of thousands of generations of mindless adaptation. We are just one species among multitudes, and therefore no more significant than any other living creature. Now comes (...) Brown University biologist Kenneth R. Miller to make the case that this view betrays a gross misunderstanding of evolution. Natural selection surely explains how our bodies and brains were shaped, but Miller argues that it’s not a social or cultural theory of everything. In The Human Instinct, he rejects the idea that our biological heritage means that human thought, action, and imagination are pre-determined, describing instead the trajectory that ultimately gave us reason, consciousness and free will. A proper understanding of evolution, he says, reveals humankind in its glorious uniqueness—one foot planted firmly among all of the creatures we’ve evolved alongside, and the other in the special place of self-awareness and understanding that we alone occupy in the universe. Here we introduce the theme of this issue of the Journal of Dharma Studies, namely, Dharma and Ecology, and give brief introductions to each article in the issue.

We analyze naturally occurring datasets from student use of educational technologies to explore a long-standing question of the scope of transfer of learning. We contrast a faculty theory of broad transfer with a component theory of more constrained transfer. To test these theories, we develop statistical models of them. These models use latent variables to represent mental functions that are changed while learning to cause a reduction in error rates for new tasks. Strong versions of these models provide a common (...) explanation for the variance in task difficulty and transfer. Weak versions decouple difficulty and transfer explanations by describing task difficulty with parameters for each unique task. We evaluate these models in terms of both their prediction accuracy on held-out data and their power in explaining task difficulty and learning transfer. In comparisons across eight datasets, we find that the component models provide both better predictions and better explanations than the faculty models. Weak model variations tend to improve generalization across students, but hurt generalization across items and make a sacrifice to explanatory power. More generally, the approach could be used to identify malleable components of cognitive functions, such as spatial reasoning or executive functions. (shrink)

Contemporary Indian identification with Hindu traditions (whether more narrowly or broadly conceived) among champions of animal protection often invokes the well-known concept of ahiṁṣā—nonviolence, as the moral basis for the position against violence toward non-human animals. To foster a more informed comprehension of this notion, this paper sets out the complex character of religious practice as presented in the Hindu scripture Bhagavad-gītā, to explore how its tenets might meaningfully apply to the practice of animal experimentation.
